Pelzer Town Council approved first reading on an Emergency Ordinance addressing temporary safety restrictions and loitering by certain individuals on Apr. 14.
The “Pelzer Emergency Youth Park Safety Ordinance” establishes “temporary safety restrictions and prohibits loitering by certain individuals in designated youth areas of Town Parks”.
The Emergency Ordinance does not require second reading and is in effect for 60 days.
Pelzer Mayor Chase Smithwick said Pelzer was approving the ordinance to get ahead of a situation like the one in Williamston the previous week and to give the state time to catch up.
The ordiance states: The Town Council of the Town of Pelzer finds that an immediate threat to public safety exists due to heightened public concern, credible reports of potential confrontation, and risk of violence in and around Town parks involving minors; and the Town has a duty to protect children and maintain safe public recreational area.
It also states that pursuant to South Carolina Code 5-7-250, the Town Council may adopt emergency ordinances necessary for the preservation of public peace, health, and safety.
The ordinance defines “Town Parks and Recreational Areas” as all land, playgrounds, athletic fields, courts, trails, and facilities owned or maintained by the Town.
“Designated Youth Areas” includes, but is not limited to playgrounds, splash pads, athletic fieldsduring organized youth activities, and any area where minors are actively congregating.
“Registered Sex Offender” means any person required to register pursuant to S.C. Code 23-3-430.
